Effective Date: January 1, 2026
1. INTRODUCTION AND ACCEPTANCE
This Service Agreement (“Agreement”) governs your use of SendGiftNow.io (“Platform,” “we,” “us,” or “our”), an e-commerce platform facilitating gift giving through social media channels. By accessing or using our services, you (“User,” “you,” or “your”) agree to be bound by this Agreement.
2. SERVICE DESCRIPTION
SendGiftNow.io provides a platform connecting gift senders, recipients, and vendors through an integrated social media gifting experience. Our services include payment processing, delivery coordination, insurance protection, and dispute resolution.
3. PAYMENT TERMS
3.1 Service Fee
All transactions processed through the Platform are subject to a 2% service fee charged to the sender. This fee covers platform maintenance, payment processing, insurance, fraud prevention, and customer support services.
3.2 Payment Methods
We accept the following payment methods:
Traditional Payments:
- Credit and debit cards (Visa, Mastercard, American Express, Discover)
- Digital wallets (Apple Pay, Google Pay, PayPal)
- Bank transfers (ACH)
Cryptocurrency Payments:
- Bitcoin (BTC)
- Ethereum (ETH)
- USD Coin (USDC)
- Sable Coin (SAC1)
- Other supported cryptocurrencies as listed on the Platform
3.3 Cryptocurrency Payment Terms
When using cryptocurrency payments:
- Exchange rates are locked at the time of transaction initiation
- Conversion to fiat currency occurs through our licensed payment processors
- Network transaction fees are separate from our 2% service fee
- Users acknowledge cryptocurrency price volatility and accept the locked rate
- Refunds for cryptocurrency transactions are processed in the original fiat equivalent or cryptocurrency, at our discretion
- Users must comply with all applicable tax obligations related to cryptocurrency transactions
3.4 Payment Hold and Release Policy
To ensure satisfaction for all parties and prevent fraud:
Escrow Period:
- Payments are held in escrow from the moment of purchase until release conditions are met
- Funds are not transferred to vendors until completion criteria are satisfied
Release Conditions: One of the following must occur for payment release:
- Recipient Confirmation: Recipient confirms receipt and satisfaction with the gift
- Automatic Release: 7 days after confirmed delivery with no disputes filed
- Sender Approval: Sender explicitly approves payment release after delivery confirmation
- Dispute Resolution: Our dispute resolution team determines appropriate payment distribution
Early Release: Vendors may request early release after delivery confirmation. We may grant early release based on vendor history, transaction value, and risk assessment.
4. DELIVERY INSURANCE PROTECTION
4.1 Coverage Included
All transactions include delivery insurance protection at no additional cost, covering:
- Lost packages during transit
- Damaged items upon delivery
- Stolen packages from delivery location (within 24 hours of delivery)
- Non-delivery due to carrier error
4.2 Coverage Limits
- Standard coverage: Up to $500 per transaction
- Premium coverage: Available for purchases exceeding $500 (additional fee applies)
- Perishable items: Coverage subject to specific terms and expedited shipping requirements
4.3 Claims Process
To file an insurance claim:
- Report the issue within 48 hours of expected delivery date
- Provide photographic evidence (for damage claims)
- Complete the claim form through your account dashboard
- Our insurance task force will review and respond within 3 business days
4.4 Claim Resolution
Upon approval:
- Replacement item shipped at no cost, or
- Full refund processed (including original service fee), or
- Partial refund for damaged items (if recipient chooses to keep)
5. RETURNS AND REFUNDS
5.1 Return Eligibility
Items may be returned or exchanged within 30 days of delivery if:
- Item is defective or damaged
- Wrong item was delivered
- Item does not match the description
- Recipient chooses to decline the gift
5.2 Return Process
- Initiate return through account dashboard or customer service
- Receive prepaid return shipping label (when applicable)
- Package item in original condition with all accessories
- Ship within 7 days of return authorization
5.3 Refund Processing
- Refunds are processed within 5-7 business days of return receipt
- Original payment method will be credited
- Service fees are refunded for defective or incorrect items
- Service fees are non-refundable for change-of-mind returns
- Cryptocurrency refunds follow Section 3.3 terms
5.4 Non-Returnable Items
The following items cannot be returned unless defective:
- Personalized or customized items
- Perishable goods (food, flowers)
- Digital products or gift cards
- Intimate apparel or health/beauty products (opened)
6. FRAUD PREVENTION AND SECURITY
6.1 Anti-Fraud Measures
We employ comprehensive fraud prevention systems including:
- Real-time transaction monitoring
- Address verification services
- Device fingerprinting and behavioral analysis
- Cryptocurrency wallet verification
- Social media account authentication
- Machine learning fraud detection algorithms
6.2 Suspicious Activity
We reserve the right to:
- Temporarily hold or cancel transactions exhibiting suspicious patterns
- Request additional verification (government ID, proof of address, video verification)
- Report suspected fraud to law enforcement and payment processors
- Permanently ban accounts engaged in fraudulent activity
6.3 User Responsibilities
Users must:
- Maintain account security and password confidentiality
- Report unauthorized transactions within 24 hours
- Provide accurate shipping and billing information
- Not engage in chargebacks for authorized transactions (use our dispute resolution process instead)
6.4 Chargeback Policy
Unauthorized chargebacks may result in:
- Account suspension pending investigation
- Permanent account termination for fraudulent chargebacks
- Legal action to recover losses and fees
- Reporting to chargeback monitoring agencies
7. PRIVACY AND DATA PROTECTION
7.1 Information Collection
We collect:
- Personal identification information (name, email, phone, address)
- Payment information (encrypted and tokenized)
- Social media profile data (with your authorization)
- Transaction history and preferences
- Device and location information
7.2 Data Usage
Your information is used for:
- Transaction processing and fulfillment
- Fraud prevention and security
- Customer service and support
- Platform improvements and personalization
- Marketing communications (with opt-out available)
7.3 Data Sharing
We share data only with:
- Vendors (shipping information only)
- Payment processors and financial institutions
- Insurance providers (for claims)
- Law enforcement (when legally required)
- Service providers under strict confidentiality agreements
7.4 Data Protection
We implement:

7.5 User Rights
You have the right to:

8. USER CONDUCT AND PROHIBITED ACTIVITIES
8.1 Acceptable Use
Users agree to:
- Provide accurate information
- Use the Platform for legitimate gifting purposes
- Respect intellectual property rights
- Comply with all applicable laws and regulations
8.2 Prohibited Activities
Users may not:
- Use the Platform for money laundering or terrorist financing
- Send prohibited, illegal, or hazardous items
- Engage in price manipulation or market abuse
- Create multiple accounts to circumvent restrictions
- Use automated bots or scrapers without authorization
- Harass, threaten, or impersonate others
- Interfere with Platform operations or security
9. VENDOR RELATIONSHIPS
9.1 Vendor Partnerships
We partner with verified vendors who:
- Meet quality and reliability standards
- Agree to our vendor code of conduct
- Maintain appropriate business licenses and insurance
- Comply with shipping and fulfillment timelines
9.2 Vendor Performance
Vendors are monitored based on:
- Delivery success rates
- Product quality ratings
- Customer service responsiveness
- Return and refund compliance
9.3 Vendor Payment Terms
- Vendors receive payment after escrow release (Section 3.4)
- Payment processing occurs within 2 business days of release
- Vendor fee structure is separate from user service fees
10. DISPUTE RESOLUTION
10.1 Internal Resolution Process
- Initial Contact: Users must attempt to resolve issues through customer service
- Escalation: Unresolved disputes are escalated to our Dispute Resolution Task Force
- Investigation: We review all evidence, communications, and transaction records
- Decision: Final determination made within 10 business days
- Implementation: Remedies implemented according to decision
10.2 Binding Arbitration
If internal resolution fails, disputes shall be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. Arbitration will be conducted in the state of Delaware.
10.3 Class Action Waiver
Users agree to resolve disputes on an individual basis and waive the right to participate in class action lawsuits.
11. ORGANIZATIONAL TASK FORCES
Our Platform operates through specialized task forces, ensuring optimal service delivery:

Responsibilities:
- Oversee data protection compliance

Responsibilities:
- Monitor platform security infrastructure

Responsibilities:
- Ensure regulatory compliance (payment processing, e-commerce laws)
- Monitor cryptocurrency regulations
- Manage licensing and certifications
- Conduct internal audits
- Liaise with regulatory authorities
11.4 Fraud Prevention Task Force
Responsibilities:
- Monitor transactions for suspicious activity
- Investigate fraud reports
- Update fraud detection algorithms
- Coordinate with law enforcement
- Implement preventive measures
11.5 Customer Service Task Force
Responsibilities:
- Provide user support Mon – Saturday 9 am – 9 pm
- Handle inquiries across multiple channels
- Process returns and refunds
- Manage customer feedback and complaints
- Train and develop support staff
11.6 Vendor Relations Task Force
Responsibilities:
- Recruit and onboard new vendors
- Monitor vendor performance
- Resolve vendor disputes
- Negotiate partnership agreements
- Ensure vendor compliance with standards
11.7 Logistics Task Force
Responsibilities:
- Coordinate shipping and delivery
- Manage carrier relationships
- Track packages and resolve delivery issues
- Optimize delivery routes and timelines
- Handle insurance claims and investigations
11.8 Marketing Task Force
Responsibilities:
- Develop marketing campaigns
- Manage social media presence
- Create promotional materials
- Analyze market trends and user behavior
- Build brand partnerships and collaborations
12. LIMITATION OF LIABILITY
12.1 Service Limitations
To the maximum extent permitted by law:
- We are not liable for indirect, incidental, or consequential damages
- Our liability is limited to the transaction value or $500, whichever is less
- We are not responsible for vendor actions beyond reasonable oversight
- Force majeure events release us from performance obligations
12.2 Exceptions
Liability limitations do not apply to:
- Gross negligence or willful misconduct
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Violations of consumer protection laws
13. INTELLECTUAL PROPERTY
13.1 Platform Ownership
All Platform content, features, and functionality are owned by SendGiftNow.io and protected by copyright, trademark, and other intellectual property laws.
13.2 User Content License
By uploading content (messages, images, reviews), you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content in connection with Platform services.
13.3 Trademark Usage
“SendGiftNow” and associated logos are our trademarks. Unauthorized use is prohibited.
14. MODIFICATIONS TO AGREEMENT
We reserve the right to modify this Agreement at any time. Material changes will be communicated via:
- Email notification to registered users
- Prominent notice on the Platform
- 30-day advance notice for significant changes
Continued use after modifications constitutes acceptance of the updated Agreement.
15. TERMINATION
15.1 User Termination
Users may terminate their account at any time through account settings. Pending transactions must be completed or cancelled before termination.
15.2 Platform Termination
We may suspend or terminate accounts for:
- Violation of this Agreement
- Fraudulent activity
- Extended inactivity
- Legal or regulatory requirements
15.3 Effects of Termination
Upon termination:
- Access to the Platform is revoked
- Pending transactions will be completed or refunded
- Personal data will be retained according to our privacy policy and legal obligations
16. GENERAL PROVISIONS
16.1 Governing Law
This Agreement is governed by the laws of the State of Delaware, without regard to conflict of law principles.
16.2 Severability
If any provision is found unenforceable, the remaining provisions remain in full effect.
16.3 Entire Agreement
This Agreement constitutes the entire agreement between users and SendGiftNow.io, superseding all prior agreements.
16.4 No Waiver
Failure to enforce any provision does not constitute a waiver of that provision.
16.5 Assignment
Users may not assign this Agreement. We may assign our rights and obligations to any successor entity.
